Terms of Service

1. Acceptance of Terms

By accessing or using RecruitHorizon.ai ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legal agreement between you and Chosen Ascendance LLC ("Company," "we," "our," or "us").

2. Description of Service

RecruitHorizon.ai is a cloud-based applicant tracking system (ATS) and human resource information system (HRIS) that provides:

  • Job posting and candidate management
  • AI-powered resume screening and scoring
  • Skills assessments with AI grading
  • Async video interviews with AI transcription
  • Automated hiring pipeline management
  • Employee management and HR tools
  • Time tracking and PTO management
  • Performance management
  • Reporting and analytics

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and have the authority to bind your organization to these Terms.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized access.

4. Subscription and Billing

4.1 Plans and Pricing

We offer multiple subscription tiers (Starter, Growth, Scale) with different feature limits. Current pricing is available at recruithorizon.ai/pricing.

4.2 Payment

Subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated.

4.3 Usage Limits

Each plan includes limits on AI interviews, assessments, email reveals, and job postings. Exceeding limits may require purchasing add-on packs or upgrading your plan.

4.4 Cancellation

You may cancel your subscription at any time. Access continues until the end of the current billing period. No prorated refunds for partial periods.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Discriminate against candidates based on protected classes
  • Upload malicious code, viruses, or other harmful content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Reverse engineer, decompile, or disassemble the Service
  • Resell, sublicense, or redistribute the Service without authorization
  • Use the Service to send spam or unsolicited communications
  • Interfere with or disrupt the Service or servers

6. Data and Content

6.1 Your Data

You retain ownership of all data you upload to the Service ("Customer Data"). You grant us a limited license to process Customer Data solely to provide the Service.

6.2 Data Processing

We process Customer Data in accordance with our Privacy Policy and applicable data protection laws. For customers in the EU, we offer a Data Processing Agreement upon request.

6.3 AI Processing

By using AI features, you consent to automated processing of Customer Data for resume screening, assessment grading, interview analysis, and related functions. You can configure automation levels per stage.

7. Intellectual Property

7.1 Our IP

The Service, including all software, designs, text, graphics, and other content created by us, is our exclusive property protected by intellectual property laws.

7.2 Feedback

If you provide feedback or suggestions about the Service, we may use them without obligation to you.

8. Third-Party Services

The Service integrates with third-party services (e.g., Stripe for payments, SendGrid for email, OpenAI for AI processing). Your use of these services is subject to their respective terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

AI-POWERED FEATURES ARE PROVIDED AS DECISION-SUPPORT TOOLS. YOU ARE RESPONSIBLE FOR FINAL HIRING DECISIONS AND COMPLIANCE WITH APPLICABLE EMPLOYMENT LAWS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. Class actions are waived to the extent permitted by law.

16. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Waiver: Failure to enforce any right does not constitute a waiver.
  • Assignment: You may not assign these Terms without our consent.
