Affiliate Partner Terms

1. Definitions

"Company" refers to Chosen Ascendance LLC, operating as RecruitHorizon ("RecruitHorizon", "we", "us", "our").

"Partner" (or "Affiliate") refers to the individual or entity enrolled in the RecruitHorizon Affiliate Partner Program ("you", "your").

"Lead" refers to a potential customer referred to RecruitHorizon through the Partner's unique referral link.

"Commission" refers to the percentage of revenue earned by the Partner for each qualifying referred customer.

"Referral Link" refers to the unique tracking URL assigned to each Partner for tracking referrals.

2. Enrollment

A Partner Agreement is concluded upon the Partner's request to enroll in the RecruitHorizon Affiliate Partner Program and acceptance of these terms. RecruitHorizon reserves the right to accept or reject any application at its sole discretion.

3. Partner Obligations

As a Partner, you agree to:

• Adhere to all applicable laws and regulations when promoting RecruitHorizon.
• Not engage in spamming, unsolicited messaging, or any deceptive marketing practices.
• Not bid on RecruitHorizon branded keywords (including "RecruitHorizon", "Recruit Horizon", or variations) in paid search advertising.
• Not make false or misleading claims about RecruitHorizon's products, features, or pricing.
• Not refer yourself, your own company, or entities you control as leads.
• Clearly disclose your affiliate relationship where required by law (e.g., FTC guidelines).
• Use only approved marketing materials or create original content that accurately represents RecruitHorizon.

4. Commission Structure

Partners earn a recurring commission of 25% of the monthly subscription revenue generated by each referred customer, for as long as that customer remains a paying subscriber.

Commission details:

• Commission Rate: 25% recurring on all subscription plans.
• Cookie Duration: 90 days. If a referred visitor signs up within 90 days of clicking your referral link, the referral is attributed to you.
• Payout Threshold: $50 USD minimum before payout is issued.
• Payout Schedule: Commissions are paid within 30 days after the end of each calendar month, provided the payout threshold has been met.
• Lock Period: Commissions are subject to a 14-day lock period from the date of the referred customer's payment to account for refunds or chargebacks.

Example earnings: A customer on the Growth plan ($149/month) generates $37.25/month in recurring commission for the referring Partner, which equals approximately $447 per year per active customer.

5. Attribution and Tracking

Referrals are tracked through your unique referral link. The last-click attribution model applies: if a lead clicks multiple affiliate links, the commission is attributed to the last affiliate link clicked before signup.

RecruitHorizon uses industry-standard tracking technology to monitor referrals. Partners can view their referral activity, pending commissions, and payout history through their affiliate dashboard.

6. Refunds and Chargebacks

If a referred customer receives a refund, cancels within the refund period, or initiates a chargeback, the corresponding commission will be reversed. If the commission has already been paid out, the reversed amount will be deducted from future commission payments.

7. Term and Termination

This agreement is effective from the date of enrollment and continues indefinitely until terminated by either party.

• Either party may terminate this agreement at any time with written notice.
• RecruitHorizon may immediately terminate a Partner's account for violation of these terms, fraudulent activity, or conduct that damages the RecruitHorizon brand.
• Upon termination, any pending commissions above the payout threshold that have cleared the lock period will be paid within 30 days.
• Commissions on future renewals of previously referred customers will cease upon termination.

8. Intellectual Property

RecruitHorizon retains all rights to its brand, logos, marketing materials, and intellectual property. Partners are granted a limited, non-exclusive, revocable license to use RecruitHorizon branding solely for the purpose of promoting the platform under this agreement. Partners may not alter, modify, or misrepresent RecruitHorizon's branding or materials.

9. Limitation of Liability

RecruitHorizon's total liability to any Partner under this agreement shall not exceed the total commissions paid to that Partner in the three (3) months preceding the event giving rise to the claim. Neither party shall be liable for indirect, incidental, consequential, or punitive damages.

10. Modifications

RecruitHorizon reserves the right to modify these terms at any time. Partners will be notified of material changes at least 14 days in advance via email. Continued participation in the program after the effective date of changes constitutes acceptance of the updated terms.

11. Confidentiality

Partners agree to keep confidential any non-public information shared by RecruitHorizon, including but not limited to commission rates, conversion data, and internal business metrics. This obligation survives termination of this agreement.

12. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from this agreement shall be resolved through binding arbitration.
