Terms of Service

1. Acceptance of Terms

By accessing and using RecruitHorizon.ai ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

RecruitHorizon.ai grants you a non-exclusive, non-transferable, limited license to access and use the Service strictly in accordance with these Terms of Service.

3. Account Registration

To use certain features of our Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and accept all risks of unauthorized access
  • Notify us immediately of any unauthorized use

4. Subscription and Billing

Our Service is offered on a subscription basis:

  • Trial Period: 14-day free trial for new accounts
  • Growth Plan: $299/month - includes 10 active jobs, 1,000 candidates, 5 team members
  • Enterprise Plan: $499/month - unlimited jobs, candidates, and team members

Subscriptions automatically renew unless cancelled before the renewal date. All fees are non-refundable except as required by law.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Upload or transmit viruses or malicious code
  • Abuse, harass, threaten, or intimidate other users
  • Attempt to bypass any security measures
  • Scrape or copy content from the Service
  • Use the Service to send spam or unsolicited messages

6. Data Protection and Privacy

We take data protection seriously. By using our Service, you agree to our Privacy Policy and understand that:

  • We process personal data in accordance with GDPR and CCPA
  • You are responsible for obtaining consent from candidates whose data you upload
  • We implement industry-standard security measures
  • Data is encrypted in transit and at rest

7. Intellectual Property

The Service and its original content, features, and functionality are owned by RecruitHorizon.ai and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. API Usage

If you use our API, you agree to:

  • Not exceed rate limits
  • Use API keys securely and not share them
  • Not use the API to create competing services
  • Comply with our API documentation and guidelines

9. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

10. Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

11. Limitation of Liability

In no event shall RecruitHorizon.ai, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages.

12. Indemnification

You agree to defend, indemnify, and hold harmless RecruitHorizon.ai from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the United States, and judgment on the award may be entered in any court having jurisdiction.

14. Class Action Waiver

You agree that any disputes between you and RecruitHorizon.ai will be resolved on an individual basis, and you waive your right to participate in a class action lawsuit or class-wide arbitration.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely reflects the intent of the original provision.

16. Force Majeure

Neither party shall be liable for any failure or delay in performance under these Terms which is due to fire, flood, earthquake, governmental action, war, terrorism, epidemic, pandemic, or other unforeseeable cause that is beyond the reasonable control of such party.

17. Data Processing Agreement

When processing personal data on your behalf, we act as a data processor and you act as the data controller. Our Data Processing Agreement is incorporated into these Terms by reference and governs our processing of personal data. The DPA is available upon request at legal@recruithorizon.ai.

18. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

19. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
